I'd want to sue my senators, representatives, members of Bush's administration, and George Bush himself for breach of contract.
"What contract?" I hear you mutter. Why, their oath to "preserve, protect, and defend the Constitution of the United States" which they took when they were sworn into office. An oath is an oral contract, one that the swearer is bound to follow or suffer the consequences. A good example would be the oath witnesses take in court to "tell the truth, the whole truth, and nothing but the truth", which, if they violate, they are arrested for perjury. Or how about the oath that members of the military take to follow orders and defend the Constitution, which if they violate, they are subject to imprisonment on a raft of charges. In some states, someone can be charged with adultery if they break their wedding vows!
So back to the matter at hand. What have these collected politicians done to qualify them to face such a suit?
Well:
- By order of John Ashcroft and others, including the President Jose Padilla is still being held in a military prison, without being charged with a crime, without being able to meet with an attorney, and now way to prove his innocence. This is all very unconstitutional.
- The Patriot act extends the power of the government to conduct surveillance on people without having to get a proper warrant. This violates the Constitutional prohibition on unreasonable search and seizure.
- President Bush has twice sent troops to war, without an official declaration of war, and without getting the approval of Congress. This is again prohibited by the Constitution.
I could extend this list for pages and pages if I wanted. There have been numerous attempts by the government to prohibit free speech, free assembly, to circumvent the separation of church and state, to remove a person's ability to carry a gun as protected by the Second Amendment, the Drug War (which IS NOT legal. According to the Bill of Rights, 9th Amendment, which states "The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people." as long as it doesn't say in the Constitution that it's illegal, or by virtue of the 10th Amendment, made illegal by a State, then WE HAVE THE RIGHT TO DO IT. This includes using drugs!). But I don't have to go on. Their actions have been publicly and egregiously unconstitutional, and easy enough to prove. Many times, these actions are caught on tape.
So what happens if I sue the above parties for breach of contract? Well I could request monetary compensation, which is the most common result of this type of suit. It'd be fun to bankrupt the government, but it's really not feasible, so I have a different solution in mind. In certain cases of Breach of Contract, the Courts order someone to fulfill their end of the contract or be arrested.
And that, that is what I want. I want the Constitution to be enforced. I want the unconstitutional acts that have been passed by Congress to be repealed. I want the people hurt by these bastards for no good reason to be compensated, and promised that THIS WILL NEVER HAPPEN AGAIN.
But most of all, I want to make sure that the politicians know that justice, real justice, applies to EVERYONE, including them, and that if they do not do what they promised, and uphold the Constitution, they must, and will be punished.
See, I'm not honestly asking for much. I feel cheated, and betrayed by those in power who feel they are untouchable and above reproach, merely by virtue of the fact that they hold office. But they are people, just like you and me, and more importantly, they are ordinary people before they are office-holders.
Being an office-holder does not exempt them, anymore than it exempts Bernie Evers of WorldCom or Kenneth Lay of Enron from being guilty of a crime.
They did something wrong, and we're making them pay.
The government should be next.
